3. What are the purposes for processing your personal data?

 

  • Compliance with legal and/or regulatory obligations issued by authorities and/or government agencies, such as, for example: payments of fees, taxes, and other legal contributions paid to the Public Treasury.
  • To identify the customer/consumer at the moment of contact for information about insurance contracting, policy conditions, contract expiration verification, and other necessary acts for the quality and safety of the services provided.
  • Identification and management of contracts, policies, claim notices, and beneficiaries under the company's supervision.
  • Understanding consumer profiles, as well as verifying compliance with legal and insurance company requirements for granting discounts and benefits, and compliance with legal and/or regulatory obligations issued by authorities and/or government agencies. 
 
 

4. With whom do we share your personal data?

 

Occasionally, it may be necessary to share your personal data with third parties. The following situations will involve sharing your information:

 

  • Upon court order and/or through a request issued by an authority with legal competence to do so.
  • For the fulfillment of legal and/or regulatory obligations issued by authorities and/or government agencies, such as: payments of fees, taxes, and other legal contributions paid to the Public Treasury.

  • Data may be shared with companies providing technology infrastructure, processes, and operationalization strictly necessary for the performance of our activities, on the understanding that all such companies have a contract with Lloyd Paulista Corretores de Seguros e Resseguros Ltda, including confidentiality and data protection clauses.
  • Sharing with auditing companies aiming at verifying the information required to audit financial and accounting issues, when necessary for the adequate provision of services and compliance with legal obligations.
 
 

5. What security measures are in place to protect your personal data?

The personal data being processed by Lloyd Paulista Corretora de Seguros e Resseguros Ltda is constantly monitored and supervised, and we have adopted the following measures to promote the security of such information:

 

  • The current controller contracted a project of legal adaptation to the General Law of Data Protection, through the execution of a contract for legal services with Sociedade de Advogados Pinho Gomes, CNPJ: 22.481.751/0001-00, with address at Rua do Carmo, 8 - 12º andar, Rio de Janeiro, RJ - CEP 20011-020.
  • Mapping and recording of all its data processing activities, as per Art. 37 of the LGPD.
  • A legal risk matrix analysis was performed based on the LGPD.
  • Development and implementation of an action plan aimed at mitigating legal risks based on the LGPD.
  • Preparation of a Response and Contingency Plan in case of security incidents involving personal data, pursuant to Art. 50, § 2, "g" of LGPD.
  • Employee training and guidance aimed at implementing a pro-privacy culture and, consequently, the mitigation of technical and legal risks based on the LGPD.
  • Hiring a Technology and Information Security consultancy company.
  • All computer terminals in the Lloyd Paulista Corretores de Seguros e Resseguros Ltda company have access control by individual login and password.
  • All computer terminals in Lloyd Paulista Corretores de Seguros e Resseguros Ltda have original software and are constantly updated.
  • All computer terminals at Lloyd Paulista Corretores de Seguros e Resseguros Ltda have antivirus software that is constantly updated.
  • Appointment and designation of the person in charge of personal data processing - DPO, as provided in Article 41 of the LGPD.
  • Setting up a privacy governance program: establishing governance rules to ensure the effectiveness of data protection and to keep up to date the operating regime, procedures, security norms, technical standards, specific obligations for the various parties involved in the processing, educational actions, internal supervision and risk mitigation mechanisms, and other aspects related to the use of personal data.
  • We review all contractual instruments with third parties where personal data is transferred in order to include standard clauses on personal data protection and privacy.
  • We have contracts with data processing agents, containing specific clauses to address personal data protection and privacy.
  • We have created a Data Retention Policy, where the procedures for storing and deleting data from all the company's systems and files will be provided for.
  • We have adopted physical and/or electronic processes for the appropriate recording and management of requests from data holders and treatment policies.

6. What are the rights of the personal data holder?

The holders of personal data may request the exercise of their rights provided in the LGPD, especially those inscribed in its Art. 18, such as, for example:

Confirmation of the existence of treatment.

Access to data.

Correction of incomplete, inaccurate, or outdated data.

Anonymization, blocking, or deletion of unnecessary, excessive, or non-compliant data.

Portability of your data to another service or product provider, upon express request by the Data Holder.

Deletion of data processed with the consent of the Data Holder.

Obtaining information about the public or private entities with which data has been shared.

Information about the possibility of not providing consent, as well as being informed about the consequences in case of refusal.

However, it is important to point out that, in certain cases, some of these rights may have their exercise limited or impossible, due to some contractual, legal, or regulatory obligation that may exist and that affects the legal relationship between the parties

7. For how long will the collected information be stored?

Data that is subject to processing may and should be stored and kept for the purpose of complying with a legal or regulatory obligation that affects the legal relationship existing between the parties.
